This page (together with the documents referred to on it) tells you the terms and conditions on which we supply our products and services. Please read these terms and conditions carefully before ordering any products from our site or engaging with our service. By accessing our site and placing an order from us, you have agreed to be bound by these terms and conditions and our term of use policy.

  1. INFORMATION ABOUT US
    • comis a website operated by Souldeliciouz Limited (“we” or “us” or “Souldeliciouz”), incorporated and registered in England, United Kingdom, whose registered office is at 86-90 Paul Street, London United Kingdom. Our Company registration number is 08152122. Souldeliciouz is a business which prepares and sells food, condiments (cooking sauces and cooking spices via www.souldeliciouz.com) and Qoolpicks flavoured toothpicks. We make and deliver food within delivery areas and delivery arrangements.
  2. PURPOSE
    • The purpose of our service is to provide high grade, quality, and edible handmade flavoured toothpicks.
  3. SERVICE AVAILABILITY

 

3.1. Souldeliciouz Ltd produces Qoolpicks 4 different flavours in small batches which have been lab tested for safe use in the mouth. Qoolpicks are packaged in plastic pillowcase style packaging to hold freshness. Souldeliciouz posts flavoured Qoolpicks Worldwide via Royal Mail postal services or other 3rd Party Postal Services.

4     ORDERS

4.1 When you place an order through our Service, an email thanking you for your order and confirming your order will be received and accepted (the “Confirmation Email”) and will be emailed to you. The contract will be between you and Souldeliciouz Limited and will only be formed when you have been presented with the Confirmation Email. We may reverse this if in case the orders have time constraints, or you are located outside our service area. Please ensure that you have given us a correct email address as this is how we will communicate with you about your order. Please also ensure that you provide an accurate address and telephone number. Souldeliciouz Ltd seeks to provide quality service. It is of utmost importance to us that we comply with high standards and maintain our reputation. Please let us know if you have any comments relating to our services by emailing or calling us.

4.2 All orders are subject to availability. If we are out of stock of your choice of flavoured Qoolpicks, we will email you offering you an alternative flavour or an option for a refund.

5   AVAILABILITY AND DELIVERY

5.1 Our aim is to provide the best service possible. Delivery of service will be based on 3rd party postal service contractual agreements. Unfortunately, things do not always go to plan and factors, such as logistics, conditions, and weather, may occasionally prevent smooth delivery.

5.2 Delivery will be completed by our authorised 3rd party courier/postal service company, to deliver the Products to the address you gave us. If no one is available at your address to take delivery, our authorised 3rd party courier/postal company, will follow the delivery instructions provided to us by you. If no ‘leave safe’ instructions are specified, the order will be left in an area that the authorised 3rd party courier company considers safe.

5.3 The leave safe location specified by you shall be within the area of the delivery address and shall be accessible to the 3rd party courier. The 3rd party courier will endeavour to follow any delivery instructions you provide but this cannot be guaranteed.

5.4 We cannot take responsibility for undelivered or lost post, however, if you do not receive your item/s within 1 week of purchase, please send us a message asap so that we can investigate what happened and find a solution in time. You are obliged to bear all expenses related to aforesaid default of acceptance.

6   CHANGES/CANCELLATION

6.1 You can cancel your order by sending us an email before 2pm on the same day of purchase or if the purchase was after 2pm, you will have to send an email before 2pm the next working day.

6.2 We will not be able to cancel orders when the order has been completed and confirmation of postage email sent to you.  We may cancel any order and will tell you once we cancel an order if payment has not been paid. You will not be charged for any orders cancelled in accordance with this clause if ample time has been given and we have not started preparing for an order.  Any payment made prior to an order being cancelled by us will be reimbursed. Any order cancelled after we have posted your items will be charged to you.

7   PRICE AND PAYMENT

7.1 The price of our flavoured Qoolpicks will be listed on our website. Prices are liable to change at any time, but changes will not affect orders in respect of which you have been presented with the Confirmation Email, save in the case of an obvious pricing mistake, whereby we will notify you as soon as we can about the pricing issue. You may be able to cancel your order once we notify you. Payment for all orders placed on our website can be made via PayPal using credit or debit card.

8   OUR LIABILITY

8.1 We make no representation or warranty of any kind, express or implied, regarding the content or availability of our Service, or that it will be timely or error-free, that defects will be corrected. We shall not have any liability to you for any direct, indirect, special, or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of or your inability to use our Service. If we are found to be liable to you, our total aggregate liability is limited to the purchase price of the Qoolpicks or Qoolpicks Holder you have paid for in your order. This does not include or limit in any way our liability for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.

9    EVENTS OUTSIDE OUR CONTROL

9.1 No party shall be liable to the other for any delay or non-performance of its obligations under this Agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion, or civil commotion. For the avoidance of doubt, nothing not included in clause 9:1 shall excuse the Customer from any payment obligations under this Agreement.

10   WAIVERS

10.1 Neither you, nor Souldeliciouz ltd shall be responsible to the others for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion, or civil commotion.

      11 SEVERABILITY

11.1 If any provision of this agreement is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.

       12 ENTIRE AGREEMENTS

12.1 This Agreement and the documents annexed as appendices to this agreement or otherwise referred to in it contain the whole agreement between the parties relating to the subject matter of it and supersede all prior agreements, arrangements and understandings between the parties relating to that subject matter.

       13 OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

13.1 Souldeliciouz Ltd may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.

      14 LAW AND JURISDICTION

14.1 The English courts will have jurisdiction over any claim arising from, or related to, a visit to our Service or use of our Services. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United Kingdom

Email marketing messages & subscription

Under the GDPR we use the consent lawful basis for anyone subscribing to our newsletter or marketing mailing list. We only collect certain data about you, as detailed in the “Processing of your personal date” above. Any email marketing messages we send are done so through an EMS, email marketing service provider. An EMS is a third-party service provider of software / applications that allow marketers to send out email marketing campaigns to a list of users.

Email marketing messages that we send may contain tracking beacons / tracked clickable links or similar server technologies to track subscriber activity within email marketing messages. Where used, such marketing messages may record a range of data such as times, dates, I.P addresses, opens, clicks, forwards, geographic and demographic data. Such data, within its limitations will show the activity each subscriber made for that email campaign.

Any email marketing messages we send are in accordance with the GDPR and the PECR. We provide you with an easy method to withdraw your consent (unsubscribe) or manage your preferences / the information we hold about you at any time.
